WE WARRANT THAT THE PRODUCT WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP FOR THE APPLICABLE WARRANTY PERIOD (AS DEFINED BELOW).

TO THE EXTENT NOT PROHIBITED BY LAW, THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. EXCEPT FOR THE EXPRESS WARRANTIES CONTAINED IN THIS LIMITED WARRANTY STATEMENT AND TO THE EXTENT NOT PROHIBITED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

THIS LIMITED LIFETIME WARRANTY IS THE ONLY WARRANTY MADE IN CONNECTION WITH YOUR SUPERSPRINGS INTERNATIONAL PRODUCT. SUPERSPRINGS INTERNATIONAL NEITHER ASSUMES NOR AUTHORIZES ANY VENDOR, RETAILER OR OTHER PERSON OR ENTITY TO ASSUME FOR IT ANY OTHER OBLIGATION OR LIABILITY IN CONNECTION WITH THIS PRODUCT OR LIMITED WARRANTY.

WHO MAY USE THIS WARRANTY?

SuperSprings International Inc. (“we”) extends this limited warranty only to the original owner who has registered their product (“you”). It does not extend to any subsequent owner or other transferee of the product.

We reserve the rights to:

• (a) require your proof of purchase as a condition of this warranty,
• (b) make future revisions to this limited warranty without prior notice.

Please note that this warranty shall apply only to products purchased from a SuperSprings International authorized seller that is subject to and follows SuperSprings International's quality controls, unless otherwise prohibited by law.

WHAT DOES THIS WARRANTY COVER?

Subject to the terms, exclusions and limitations in this Warranty Statement, SuperSprings International, Inc. warrants to the initial purchaser only that its SuperSprings International product shall be free of defects in material and workmanship for the applicable Warranty Period, as defined below.

WHAT DOES THIS WARRANTY NOT COVER?

Your Limited Lifetime Warranty does not cover any damage arising from or related to any vehicle, product, or component combination other than the SuperSprings International product. Your Limited Lifetime Warranty further does not cover vehicles, products or components supplied by us or others that we determine to have been damaged by or subjected to:

• Vehicle use in excess of gross vehicle weight rating, combined vehicle weights / tow ratings or other Original Equipment Manufacturer design specifications or limitations;
• Normal wear and tear, deterioration of spring shape or rating, alteration, product modification, improper installation;
• Scratches or defects in product finishes (powder coating, paint, etc.) or damage due to shipping;
• Abnormal use or misuse, including products used other than as recommended in the current SuperSprings International application guide or the instructions;
• Racing or other vehicle competitions or contests;
• Accidents, impact by rocks, trees, obstacles or other aspects of the environment or through other actions or events beyond our reasonable control;
• Heavily loaded commercial use on unpaved road conditions;
• Failure to follow the product instructions or to perform any preventive maintenance; or
• Modifications or unauthorized repair;

WHAT IS THE PERIOD OF WARRANTY COVERAGE?

This limited warranty starts on the date of your purchase and lasts for as long as you own the vehicle on which the product was installed, for all consumer applications. All commercial applications are warrantied for 3 years, starting on the date of purchase. “Commercial applications” means any vehicle intended for, licensed for, or used (partially or otherwise) in connection with a business or trade and shall include, but not be limited to, “Commercial Motor Vehicles” as defined or intended by the U.S. Code of Federal Regulations. All other applications are “consumer applications.” The Warranty Period will not be extended if we repair or replace the product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

With respect to any defective product during the Warranty Period, we will, in our sole discretion, either repair or replace such product (or the defective part) free of charge. We will also pay the shipping and handling fees to return the repaired or replacement product to you. We will not reimburse you for repairs or replacement parts provided by anyone else.

HOW DO YOU OBTAIN WARRANTY SERVICE?

No warranty service will be provided without an RMA number. All removal, shipping and installation costs are your responsibility. If a replacement part is needed before yours can be returned, you must first purchase the replacement part through SuperSprings International. Then, if we determine your part to be covered under a valid warranty claim, you will be credited the purchase price.

LIMITATION OF LIABILITY

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

WHAT CAN YOU DO IN CASE OF A DISPUTE WITH US?

We take great pride in our customer service. However, if for any reason you are not satisfied with the handling of your warranty claim, the following informal dispute resolution procedure is available to you, unless you elect to bring an eligible claim in small claims court against us.

We will attempt, in good faith, to resolve the dispute with you. If the dispute has not been resolved within 40 days of our receipt of your written notice, we and you agree to the dispute to be resolved by arbitration in Santa Barbara, California. The tribunal shall have the power to rule on any challenge to its own jurisdiction or to the validity or enforceability of any portion of the agreement to arbitrate. You agree to arbitrate solely on an individual basis, and that this warranty does not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding. The arbitral tribunal may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. Notwithstanding the tribunal's power to rule on its own jurisdiction and the validity or enforceability of the agreement to arbitrate, the tribunal has no power to rule on the validity or enforceability of the agreement to arbitrate solely on an individual basis. In the event the prohibition on class arbitration is deemed invalid or unenforceable, then the remaining portions of this arbitration provision will remain in force.
